Before you begin your process of filing for a Divorce and Custody of your children here are some things to consider
- There are two types of Divorce in Maryland, absolute and limited. There are 8 grounds for a absolute divorce in Maryland: adultery, desertion, Voluntary one year separation, criminal conviction, two year separation, insanity, cruelty, and excessively vicious conduct. There are 4 grounds for a limited divorce: cruelty, excessively conduct, desertion and voluntary separation.
- Voluntary separation is when two parties agree that they need to go their own way. This means no cohabitation and sleeping in different locations at all times. Separate bedrooms in same house does not count.
- You can discuss a separation with your spouse and agree on temporary agreements. A handwritten agreement signed by both parties will be able to be used in court.
- Once separated you can apply for several types of relief through the courts. Most states have implemented child support guidelines. Spousal support or family maintenance may also be granted, the court mostly assess the needs of the party asking for relief and the ability the other party has to contribute.
- The court usually uses the best interests of the child to determine a custody situation. Two parents may share custody of the children or one parent may have sole custody.
